Logicracy Conditions and Terms of Service You will need to scroll this text box to read all the text of these conditions and terms of service (called "terms" herein), which ends with the phrase "END OF TEXT". If you cannot read all of the text or cannot scroll to the phrase "END OF TEXT" at the bottom, then you are prohibited from dealing with Logicracy. By dealing with or using Logicracy you agree to be bound by this contract, these conditions, and these terms of service, and that you qualify according to the conditions specified herein. If you do not accept and qualify as laid out in these terms, then you are prohibited from using Logicracy. The word "Logicracy" herein refers to the service and content under the domain names logicracy.com, logicracy.net, logicracy.org, and logicracy.us, and the organization owning and providing the service and to its officers, associated services and web sites, associates, employees, licensors, subsidiaries, affiliates, partners, and agents. The word "service", "site", and their forms herein, unless otherwise noted, refer to Logicracy. The word "investment" herein refers to your time, material, valuables, money, ideas, submissions, thought, research, loss, harm, and work. The words "use" and "deal" and their forms herein when applied to Logicracy refer to any communication, viewing, using, correspondence, accessing, studying, copying, referencing, quoting from, altering, editing, submitting material to, relying upon, promoting, or exposing to minors, etc., or causing or supporting these things regarding Logicracy. The words "you", "your", "user", "entity", and their forms in this document refer to any person, entity, or group dealing with Logicracy. These terms are your complete and sole agreement in using Logicracy. Anything indicated or implied by statements or the lack of statements, action, or inaction you find elsewhere or in correspondence with Logicracy does not override these terms. If at any time you do not or cannot accept or comply with any part of these terms, you do not confidently and fully understand them, you violate any part of these terms, you do not believe they are completely clear and without contradiction, you do not know or understand applicable laws, or you believe there might be possible conflict with applicable laws or rules, then you are prohibited from using Logicracy and all your rights laid out in these terms are revoked. When you are in a state or under a jurisdiction that does not allow all forms of exclusion and limitation of liability for incidental or consequential damages, does not allow all forms of the exclusion of implied warranties, and does not allow any part of these terms to take full effect exactly as they are written, then you are prohibited from using Logicracy. This rule applies in spite of other attributes and actions by Logicracy. For example, you might find evidence that Logicracy has knowledge that entities in such a state or jurisdiction are dealing with Logicracy or you might see the name of such a state or jurisdiction in content implying users may use Logicracy while in such a state or jurisdiction. Such may occur because Logicracy does not keep track of all state and local laws. It is up to you to know and understand the laws that apply to your dealings with Logicracy. If you are barred from forming a binding contract or are younger than 13 years of age, then you are prohibited from using Logicracy. If you are not of a legal age to form a binding contract or are younger than 18 years of age, your parent or legal guardian must accept these terms before you deal with Logicracy. You agree to indemnify and hold Logicracy, and its officers, employees, licensors, subsidiaries, associates, affiliates, owners, partners, and agents harmless from any claim or demand, including reasonable attorneys' fees, made by any entity due to or arising out of your dealings with Logicracy, your violation of the terms, or your violation of any rights of another. These terms will be governed by and construed in accordance with the laws of the state of Alabama, without giving effect to its conflict of laws provisions or your actual jurisdiction, state, or country of residence. If for any reason a court of competent and applicable jurisdiction finds any provision or portion of the terms of service to be unenforceable, the remainder of the terms of service will continue in full force and effect. These terms may change from time to time without notice to you. You agree to periodically review these terms and the appearance and functionality of the site. The service is provided "as is" and "as available". The service may not be provided at all times, may not operate as described herein and in other documentation, and may have faults that could cause harm or loss. The appearance and functionality of the service may change, increase in functionality, or decrease in functionality from time to time without notice. Such changes do not indicate a change or retraction of the terms. No warranty, guarantee, or maintenance agreement is expressed or implied for the service's security, resistance to hacking, accuracy, privacy, reliability, usefulness, appropriateness, functionality, longevity, legality, harmlessness, safety, or anything else. The communication methods provided by the service and any associated site contact information are not private (for example, as occurs in forums, so-called "private" messaging, chatting, references to other sites that allow such things, etc.). Use of the site requires that you create a permanent account in the site. Much of your interaction with the service may be recorded and analyzed individually and statistically, and the results published and distributed without notification to you. This includes anything you might submit as well as other information received when you interact, such as information your browser automatically sends in HTTP protocol data, your IP address and the geographic region it indicates. Using the site will cause cookies to be stored on your computer, which may contain some basic information such as your account username, user number, and an account session ID value, among other things. The service is provided only via web pages accessible via the internet. No other method of access is provided. You are responsible for obtaining access to the service and all its content (including user submitted material and advertisements) and you understand that that access may require an investment from you or cost you (such as the cost of computer and connection hardware and maintenance, network configuration, internet service provider fees, data connection fees, taxes, etc.). The processes performed by the service are based on untested theory, and may produce unexpected, misleading, or incorrect results. Logicracy is not controlled by competent legal experts. Those in control may make legal and technical mistakes. The material you submit to Logicracy may very well be altered, misrepresented, damaged, lost, ignored, mishandled, used by others to harm you or others, not returned, distributed, and/or made public without notice. The service may contain some copyrighted, owned, and proprietary content, algorithms, equations, and intellectual property. Logicracy very much wishes to provide a 100% family site. However, because of its automated nature Logicracy cannot reliably regulate or review the material submitted and published by users. There is no reliable or consistent reviewing, judgment, or regulation of material, references, or communications. There is no feature to reliably protect users from harm or loss from any source. Therefore you understand that some content may be inappropriate, unacceptable, or illegal. You will not deal in such material and you take sole responsibility for preventing those persons for which you are responsible from accessing that material. Other users, products, services, organizations, and advertisers using, recommended by, you discover, or access through the service are often not controlled, reviewed, or judged by Logicracy and they may cause loss, harm, or exposure to illegal or inappropriate material. Correspondence and other interaction with Logicracy may be unreliable at times. Logicracy reserves the right to be the ultimate judge of whether a user's conduct or submitted material is unacceptable, regardless of these terms, and may suspend or bar access of the service on an individual or group basis (even if some members of that group have done nothing unacceptable), or alter or remove submitted material or accounts, regardless of any investment in the service. If that happens to you, Logicracy will not reimburse, prorate, or compensate you for any investment you have made. You agree that Logicracy will not survive forever. You realize the service could be shut down for any reason at any time and without notice, and that you have no say in the matter regardless of your investment. Logicracy may suspend the service for maintenance, may implement automatic deletion, modification, compression, etc. of submitted material and other things to help the site to run efficiently and conserve site resources, for example. Logicracy will never intentionally reveal to anyone the text you enter into the email field of the account creation page, except in cases that are not likely to result in spamming, which include but are not limited to: investigations of possible illegal activity, government requests, legal litigations, response to claims, customer service, protection of users, technical problem resolution, etc. Even so, you realize that Internet sites and networks can be monitored and hacked by malicious persons and that email is not a secure form of communication by nature. Logicracy cannot control this and you understand that such may happen. You agree to allow Logicracy to contact you using the email address you enter in the email field of the account creation page or any other contact information that might be known or found by Logicracy. Logicracy will try to keep these communications limited to those that Logicracy feels you are likely to be interested in, such as issues involving your particular account or important changes in the operation of the service. This does not mean, however, that Logicracy is obliged to contact you in these matters. Logicracy does not necessarily take the same commonly used security measures that other sites use. You agree not to deal with Logicracy or other users in a way that they may not want. You are responsible for keeping private all private information that you possess. You agree not to submit any material to the site that other users could use, directly or indirectly, to harm you or others or discover private information about you or others. This includes but is not limited to information such as a user or group's real name, physical address, telephone number, email address, P.O. box number, social security number, private access codes/numbers/passwords, information that might help someone to discover these things, etc. You agree not to transfer your account or other site resources or privileges of which you have control to other entities, even temporarily. You may not sell or give your account to another. You agree not to misrepresent your opinions or abilities in your dealings with Logicracy. You agree not to compensate or encourage others to violate these terms or misrepresent their own opinions or abilities in their dealings with Logicracy. You are fully and solely responsible for all activity that occurs through your account. Therefore it is paramount that you keep your password private, properly log out before you leave your computer unattended, understand and prevent possible monitoring of your network activity (electronic or otherwise), verify that the Internet domain name displayed in your browser’s URL address field is logicracy.org, and choose a password that is virtually impossible to guess even by automated means. Even so, you understand that such security breeches can happen and that the network connection to the service is not secure. You understand that these things cannot be controlled by Logicracy. You take full responsibility for actions performed using your account and associated consequences. You agree not to deal with material (whether in your possession or that you encounter on the site) that is illegal, intellectual property, inside information, lies (except as an optional answer to a question), libelous, slanderous, threatening, abusive, defamatory, unfair, vulgar, pornographic, obscene, satanic, promoting lawlessness or harm, hateful, or private. You agree not to deal with innuendo of these things, or material that promotes or tempts others to deal with these things or do something illegal or against the Terms. You agree not to deal with trademarks, service marks, or other names and marks illegally. You agree not to deal with material that is a patent infringement, trade secret, or proprietary. You agree not to reveal information leading to the identity of any user along with any implication that that user committed any disagreeable act, except in a private "abuse report" as described in the FAQ. You agree not to submit material that contains even the most mild of profanity. You agree not to deal with any material that could cause harm to a computer or software, such as but not limited to viruses, worms, trojans, adware, spyware, harmful programs and scripts, or material that may take advantage of faults in software used to process or present it. You agree not to deal with Logicracy in any way that disrupts the smooth operation of the site or harasses other users or hinders them from using the site efficiently. You agree not to deal with the service in a way that could tax the service's computer or networking resources. This includes but is not limited to excessive network activity, unnecessary or excessive requests to process, and excessive data sent to or received from the site. You agree not to rely upon, in any important way, Logicracy. You agree not to use the service in a situation related to anything of value or health or safety. You grant rights and licenses allowing Logicracy to (without attribution) distribute, delete, publish, edit, alter, copy, store, transfer, incorporate into other works, and publicly perform and display the material that you submit and you agree not to submit material that cannot legally and ethically experience any of these things. You take full responsibility for any consequences of publishing material through the service, and hold Logicracy harmless. Logicracy is not a publisher. Just as the maker of printing presses cannot create a press that can review the material it prints, Logicracy cannot review the material submitted to it. If you submit material, then you are the publisher. You accept that after you submit material, you may lose control of that copy of the material (you may not be able to delete or modify the material, for example). You agree not to distribute any email addresses or other contact or private information controlled by or associated with Logicracy or its owners or associates. You agree not to attempt to hack, reverse engineer, or take advantage of unintentional behavior or bugs in the service in any way. You understand that others may publish, distribute, reference, quote without attribution, misquote, misattribute, associate with something illegal or harmful, copy, or edit (even illegally or harmfully) the material you submit and you agree to hold Logicracy harmless for this. You agree to use the service only for the purpose for which it is intended. You agree not to use the service for commercial gain, selling a product or service, solicitation, advertising, spam, chain letters, money-making schemes, etc. You agree not to use the service to enhance the functionality, usage, or traffic of another service or product. You agree not to use the service in a way that would hide the fact that features used are those of Logicracy, or cause the service to appear or operate differently. You may not mirror or copy the service's web site in whole or in part. The service and all its content may only be directly accessed and used by a human manually using a standard, well-known web browser which fully supports standard HTML, JavaScript, and cookies and which is directly connected (or connected through a standard network router, proxy, or gateway using standard network protocols) to the service's HTTP web server. Access in any other way is prohibited. Prohibited accesses include but are not limited to accesses that change or hide the appearance, functionality, internet address (URL), or intent of the service, accesses by other types of programs, bots, automated processes, protocols other than HTTP, frames of other web pages, hotlinks (automatic links, embedded in content not on the Logicracy server, to resources residing on a Logicracy web server), server-side or client-side scripts or programs, embedded scripts and HTML, redirections, copies, other web sites, etc.. When resources in a Logicracy server are hotlinked or presented in a frame from another site or accessed in a prohibited way, they may intentionally or even unintentionally act differently or in a way that may be harmful to the site or entity that is supporting, providing, accessing, or using the content that contains the link. For one example, a web page or forum post on another server that includes a hotlink to a resource on a Logicracy server may cause that resource to indicate that it is illegally hotlinked (whether it really is illegal or not), or cause some problem (such as missing content, a delay, or improper operation) in the processes attempting to use or present it, or reveal information or present itself in a way that is harmful to the site or entity that is supporting, providing, accessing, or using the content containing the hotlink or frame code. Logicracy may try to control this behavior generally or in specific cases, but nothing can be guaranteed. You may retain, distribute, and display up to 500 pieces of content (text, images, sounds, or videos) taken from the service (except for skill-testing questions and their content) as long as you include a unique, useful, applicable, and meaningful commentary, written by a human, associated with each piece of material, you make sure each piece will be accessible at least three full days before it is deleted, and you do so legally and without harm to anyone and you use commonly accepted and legal fair use journalistic quoting with attribution. More than 500 pieces of content may not be kept in the same place (repository, site, account, blog, database, etc.). For example, you can quote and comment on material taken from the service in your commentary, news article, blog, web page, or forum or USENET post as described here. Retaining, displaying, or distributing skill-testing questions, more than 500 pieces of material from the service, or taking advantage of a quick turn-around of content from Logicracy (deleting content quickly or automatically to make room for more content in order to stay below the 500 piece limit) is prohibited. Very well-known internet search services like Google™ and Yahoo® have the right to retain, display, and allow automated searching of more than 500 pieces of text or images taken from Logicracy (except for skill-testing questions), and they may do so without commentaries and they may take them from Logicracy by automated means, but only if they present the content from Logicracy as generically and to the degree that they present text and images from at least 100000 other existing web domains of no specific category, and their service is not presented as anything but a general (non-specific) web search or browse service of non-specific and uncategorized pages from the web. They also have the right to attempt to present pages and images from Logicracy in a frame as long as the pages appear in their complete form. You agree to obey international laws with regard to the service. For example, certain forms of encryption and information may not be dealt with, exported, or imported in certain countries. You realize that the service makes it possible to submit and access submitted material from any place in the world. You agree not to deal with such material. Your investment in the site does not give you any control or voting power in the operation of the site or Logicracy. You may transfer money to Logicracy only in the way specifically described on the site’s web page dedicated to that. Note that any valuables, payments, or donations you make to or for Logicracy are not tax deductible. Logicracy will make a reasonable effort to provide the advertised premium services to those who have made a payment, but service cannot be guaranteed considering the various unforeseen events that can occur such as the hacking of the site, failure of software or hardware, loss or change in the abilities of those maintaining the site, faulty documentation, legal orders, lack of funds, etc. Thus you accept that the service may not perform as you expected in spite of your payment or investment, and you accept that you will not be reimbursed or compensated in any way no matter what happens. You will consider your investment a donation, only. If you terminate or cease to use a part of the service for which you have paid, you will lose that investment. In no case will Logicracy reimburse, prorate, or compensate for the balance of any payment or investment made or services due. You agree to fully test, understand, and accept the service's features before making any investment. There may be products, product names, trademarks, service marks, owner/company names, and designs referenced, used, or accessible through Logicracy and its documentation that are owned and created by others, and not owned or were created by Logicracy. You are responsible for researching and obeying the terms and licenses of things you encounter on or through the site, in spite of possible incorrect references, incorrect or missing indicators of ownership, or incorrect information appearing in the service's documentation, web site, or submitted material.
